【背景】

记者14日从最高人民法院获悉，为有效预防和依法惩治高空抛物、坠物行为，最高法近日印发关于依法妥善审理高空抛物、坠物案件的意见，切实维护民众“头顶上的安全”。根据这份意见，对于故意高空抛物的，根据具体情形按照以危险方法危害公共安全罪、故意伤害罪或故意杀人罪论处，特定情形要从重处罚。

周四，最高人民法院（the Supreme People's Court）印发关于依法妥善审理高空抛物、坠物（objects that fall or are thrown from tall buildings）案件的意见（guideline），在法律适用上明确区分（accurately distinguish）了抛物（objects thrown by people）和坠物（those falling from buildings）行为。
《意见》规定，对于故意高空抛物的（people who throw objects with purpose），根据具体情形按照以危险方法危害公共安全罪（crimes of endangering public safety by dangerous means）、故意伤害罪（intentional injury）或故意杀人罪论处，特定情形要从重处罚。
意见明确提出，依法从重惩治高空抛物犯罪。具有下列情形之一的，应当从重处罚（harsher punishments），一般不得适用缓刑：多次实施的（those throwing objects from tall buildings several times）；经劝阻仍继续实施的；受过刑事处罚或者行政处罚后又实施的；在人员密集场所（in crowded places）实施的；其他情节严重（serious situations）的情形。
最高法表示，这一包括16条措施的指南旨在通过更严惩罚措施（stricter punishments）来保护人民群众的人身和财产安全（protect people's lives and property），促进社会和谐稳定。
禁止高空抛物或坠物一直是公众讨论的热点问题（hot issue），因为此类悲剧频发。
今年8月22日，民法典编草案（the draft section of the civil code）第三次提请（submit）十三届全国人大常委会（the Standing Committee of the National People's Congress）第十二次会议审议。
草案三审稿对高空抛物坠物新增多处规定，包括禁止从建筑物中抛掷物品（the prohibition of throwing objects from tall buildings）；建筑物管理人（those responsible for building management）应当采取必要的安全保障措施防止此类情形的发生，确保施工安全（ensure construction safety）等。
